Qualification Suite provides customers of msg life and its own employees (‘Users’) with training courses in various subjects in both analogue and digital formats. The range consists of courses in various formats such as live online training, face-to-face training, video seminars and a combination of these. The course descriptions and prices displayed in Qualification Suite on the booking date apply. The participation fees shall be billed as soon as the User registers and are payable immediately.
With the exception of face-to-face and live training, course content is normally accessible for 12 months from the booking date unless stipulated otherwise in the description of the course in question.
Users of Qualification Suite must initially register and create an account with their data and a customer-specific verification code. You will receive a confirmation of registration by e-mail after you register. Every participant must register themselves. This ensures that every User receives personal access to Qualification Suite. The log-in details may not be disclosed to third parties. msg life is entitled to block User access to Qualification Suite without providing a reason if a User does not use the services provided by msg life for one year. When a User is about to be blocked, the training officer shall be notified by e-mail two weeks in advance.
Furthermore, msg life is entitled to block access immediately, at any time and without providing a reason if the User violates a material contractual duty, the law or the rights of a third party.
Every User is entitled to have their Qualification Suite account deleted at any time and without providing a reason. Account deletion does not release a User from their payment obligations.
After registering, the User can book available courses. A booking is successful as soon as the User receives a confirmation e-mail. If a course contains live modules (events), the participants must register for the event dates separately. Unless stated otherwise in the course description for live training, all courses are ‘subject to availability’, i.e. until the maximum number of participants is reached. If an event is fully booked and no alternative date is available or the participant is unable to take part on that alternative date, the fees for that part of the course shall be refunded at the request of the training officer. The participant is not entitled to have fees refunded for the entire course.
A live event booking can be changed to another date once, subject to availability; this must be done no later than seven days prior to the start of the event. We do not charge administrative fees for changing a booking. If the original live date or alternative date is cancelled, the participation fee shall not be refunded. The same applies if the User does not participate or cancels the seminar.
We reserve the right to cancel a live event at short notice due to a lack of demand or insufficient participants (no later than five days prior to the scheduled event date) or for any other reason (e.g. the speaker suddenly falls ill or force majeure). In this case, we shall arrange an alternative date promptly. In this case, participants are not entitled to have an event take place. If an event has to be cancelled and no alternative date can be found in coordination with the User, the fees for that part of the course shall be refunded at the request of a participant. Participants have no more extensive claims against us. Please also take this into account for hotel rooms and plane or train tickets you have booked.
msg life is entitled to make necessary changes to or deviations from content, methods or organisation (e.g. due to legal changes) prior to or during the training, provided that these do not significantly change the benefit of the announced event for the participant. With regard to events, we are entitled to replace the scheduled speakers with other people who are similarly qualified in the announced topic if necessary (e.g. due to accident or illness).
Furthermore, msg life expressly reserves the right to modify, supplement or delete some or all of the content of the individual Qualification Suite courses as well as the Qualification Suite platform, and to stop providing them temporarily or permanently, without prior notice. If a course is removed from the portfolio for this reason or due to the unavailability of the speaker, force majeure or other unforeseeable circumstances, Users are not legally entitled to have that course provided. The training officers and participants shall be notified of this immediately in writing or by e-mail. Any paid fees can be credited towards participation in other training courses or refunded. The participants have no further claims against msg life.
All information, data or documents to which the User or the related company gain access through the services must be treated as confidential and/or proprietary, regardless whether they are verbal or in writing. In particular, these include trade secrets, software, concepts, documents, knowledge and experience and other data and information (‘Confidential Information’). Such Confidential Information may not be sold, published, reproduced or otherwise disclosed to any person or other company without the written consent of msg life. It may only be used for the purposes of the training.
These obligations do not apply to Confidential Information which:
msg life shall strive to make Qualification Suite accessible at all times. However, it offers no assurance that Qualification Suite will be available at all times. In particular, access can be restricted temporarily for technical reasons, such as necessary maintenance and repair work.
msg life reserves unrestricted ownership of all training materials until all payment obligations have been fulfilled by the customer. Training documents or materials may not be duplicated, altered, recorded, transferred to third parties or disseminated or disclosed to the general public. In particular, it is forbidden to publish audio or video data, screenshots, digital presentations or scripts in public online portals (i.e. sharing).
The documents provided as part of the courses have been generated on the basis of the current state of knowledge. However, no liability is accepted and no guarantee is made that the content is accurate, up to date, complete or of high quality.
The content of all courses and documents, especially training materials, is our intellectual property and is protected by copyright. It may only be used by the registered participants to whom it has been made available. Events may not be duplicated, altered, shared, distributed to the public, rendered accessible or recorded (video, audio or screenshots).
The participant undertakes to respect the copyright of msg life and only use course content and training materials for their personal use, for the purposes of the contractual agreements and in their capacity as an employee of the customer.
msg life cannot be held liable for property damage or purely financial losses – regardless of the legal grounds – suffered in connection with the use of Qualification Suite unless the damage was due to a violation of a material contractual duty or any other intentional or grossly negligent breach of duty on the part of msg life, its legal representatives or vicarious agents, or it is liable under mandatory law due to an injury to life, limb or health or for any other reason. Material contractual duties are duties which must be fulfilled in order to permit the due execution of the contract and on the fulfilment of which the contractual partner can therefore normally rely, as well as duties which are of fundamental significance to the protection of the contractual partner and those of its legal positions that are essential to the contract. Liability for property damage or purely financial losses resulting from an ordinarily negligent breach of a material contractual duty is limited to compensation for the foreseeable damage upon the conclusion of the contract.
In connection with courses in Qualification Suite, links to third-party websites might be referred to verbally or in writing as sources of more extensive information. msg life only refers to such links as a courtesy. Therefore, it is not liable for whether the information provided there is accurate, up to date or complete, and cannot be held responsible for the content of these other websites.
The participant must meet the minimum requirements (Internet connection, up-to-date browser version, microphone or headset etc.) and test them prior to the event. Failure to meet the technical requirements does not release participants from their payment obligations.
Where legally admissible, the place of jurisdiction is Munich.
